The PICCR was established in 1994 and accorded official
status by Yasser Arafat as an independent organization which oversees
government actions in the area of citizens' rights. PICCR's
goal is to ensure the compliance of the Palestinian Authority
with international human rights standards and the principles of
good government.
In order to meet its goals, the PICCR reviews laws,
regulations and procedures, governmental structures, and administrative
policies of public officials and organizations. PICCR is mandated
to review and participate in the formulation of draft legislation,
including the draft Basic Law. It also reviews and makes recommendations
for the judiciary to ensure independence and professionalism,
and assists the security structures in observing human rights
standards through training assistance and proposals on proper
procedures related to criminal investigations.
PICCR is also empowered to investigate complaints
brought by individuals concerning misadministration or infringement
of rights by government bodies and recommending appropriate solutions,
including a change in policy or procedure, financial compensation
for injury or damage, cancellation of an unfair or biased decision.
The Commission may investigate complaints in such areas as:
physical abuse, torture or death in detention; improper arrest
procedures; patronage in hiring or arbitrary firing; discrimination
on the basis of sex, religion or political opinion in application
of the law; misuse of public funds; bribery or corruption; denial
of basic rights (e.g. freedom of speech or assembly; misadministration
(e.g. improper application of the law).
In matters of urgency or obvious public interest,
the Commission may begin an investigation without waiting for
a complaint from a member of the public. For serious violations
of civil rights, the Commission can recommend any effective means
of investigation and remedy, such as a public commission of inquiry.
In its first year of operation, 350 complaints were
submitted, about one fourth of which resulted in intervention
from PICCR to the ministry or agency involved, recommending a
change of policy.
